General terms and conditions for website users and customers


By using this site you are agreeing to these terms and conditions.

These terms and conditions will apply to all transactions placed online, by e-mail, telephone or by post with the Cotswold Outdoor Ltd group. Please read carefully before placing any order. All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights.

All references to the 'company', 'us' or 'we' will refer to the Cotswold Outdoor Ltd group. All references to the customer shall mean the person or persons purchasing or agreeing to purchase goods from the company. All references to the Web Site shall include reference to all URL's owned by the Cotswold Outdoor Ltd group.

Price match

We are determined to give you a fair deal. If you find a product we sell for less with other retailers and it is in stock, we will match the price or refund the difference.

Guaranteed quality

In addition to manufacturer guarantees, we provide a one year money back guarantee. So if you find a product to be faulty, you can return it to us with proof of purchase for a full refund or exchange.

Hassle-free returns

If you are not delighted with your purchase, you can get a refund or exchange by sending it back in new condition with the returns slip or by bringing it in to one of our stores with your receipt within 28 days.

Orders


We are pleased to accept orders by any of the following methods. Online transaction (secure server), e-mail (unsecure), telephone, post, fax or through any of our stores nationwide. Please refer to our latest catalogue payment section for details. All credit / debit card transactions are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, Maestro and Solo. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and / or non-delivery of your order.

No orders will be accepted or processed without a valid card payment in the name of the registered cardholder.

Delivery


Items ordered will be delivered as soon as possible in accordance with the requested delivery service. Charges for the different delivery services can by obtained from our Customer Service Department and are also listed within the current main catalogue. All delivery charges are subject to change without prior notice. Every effort is made to ensure that delivery is made within the estimated time scales and a maximum of thirty days. All goods are subject to availability. In the event that we are unable to supply your goods within thirty days, we will inform you immediately and advise you of the expected delivery date. Outstanding orders / items can be cancelled at any time. In instances where payment has already been made, (Post Orders with a cheque), an alternative or refund in full for the item(s) concerned will be given.

In the event of any goods delivered by us being damaged in transit, deficient of items shown on the delivery note or failing to match the items ordered by you, then such details must be notified by you to us within seven working days of receipt. If we receive no such notification the customer will be deemed to have accepted the items as satisfactory. We cannot be held liable for any consequential loss caused by late delivery or failure to deliver by the company's appointed carrier. Liability in such cases is limited to the value of those items, which are shown to have not been received by the customer.

BFPO Delivery: Please note that parcels direct from Cotswold Outdoor to BFPO addressses do not quality for free delivery as per the BFPO's relatives and friends service, therefore BFPO deliveries will be charged at our standard BFPO delivery rates. If you wish to take advantage of the BFPO free delivery scheme for relatives and friends, you will need to take your parcel to the Post Office.

Returns and Exchanges


We want you to be entirely satisfied with every purchase made from the Cotswold Outdoor Ltd group and strive to offer you excellent quality, value and service at all times. If you wish to return an item for exchange or you have decided not to keep it, please complete the details on the reverse side of your delivery note and send it back to us or bring it in to one of our stores together with the products original packaging and labeling within 28 days. We will exchange or refund the cost of the item(s) where appropriate. All goods must be in a new and unused condition together with a copy of your original receipt.

If you wish to return any item due to it being faulty, please complete the details on the reverse side of your delivery note giving details of the fault and send it back to us together with the item in its original packaging, where possible, within 28 days. We will exchange the item or refund the full cost including any delivery charges incurred where appropriate.If you are in any doubt, please contact our customer service department. We are here to help you. We recommend that all items returned to us be sent recorded delivery with insurance paid as a minimum. Your local Post Office will be able to advise.

Prices


All prices are shown in pound sterling (£) and are inclusive of UK VAT at the current rate unless clearly stated otherwise. All prices are subject to change without prior notice.

If you have purchased or wish to purchase an item from Cotswold Outdoor and find the same item offered for sale at a lower price by any other retailer, we will refund the difference or match that price (including postage and packaging) . This offer is available on current season products in stock at the time of purchase and on products of an identical style, size and colour that are held in stock by other UK retailers. All price matches must be carried out within 7 days and availability and price must be confirmed by the store or call centre. No further affiliate, promotional or media discount applies.

Gift vouchers


Cotswold Gift Vouchers can be redeemed for goods in any Cotswold Outdoor store or online at cotswoldoutdoor.com. However, our vouchers cannot be redeemed for cash or gift vouchers or be used as payment on an existing credit agreement. For purchases in store, where Gift Vouchers offered have a greater value than the goods being purchased, no change will be given above £4.99. For online redemption, the value of items purchased online cannot be less than the total value of the Gift Voucher. Multiple Gift Vouchers may be redeemed in the same transaction up to the value of the goods being purchased.

Gift Vouchers will expire on the date marked on the Gift Voucher. Gift Vouchers presented after their expiry date will be treated as void and are non-exchangeable and non-refundable.

Gift Vouchers cannot be returned or refunded, except in accordance with your legal rights. They should be treated as cash, as Cotswold Outdoor is unable to replace a gift voucher if lost or stolen. Cotswold reserves the right to refuse to accept a Gift Voucher which it deems to have been tampered with, duplicated, damaged or which otherwise is suspected to be affected from fraud.

Cotswold Outdoor reserves the right to change any of these terms and conditions from time to time without notice and to take appropriate action including cancellation of the voucher if, at its discretion, it deems such action necessary. Changes will be published in Cotswold Outdoor stores and online at cotswoldoutdoor.com.

Products


Products are sold singly unless otherwise stated and are not always available through every outlet. Every effort is made to ensure the colours depicted on the site match as closely as possible those of the actual product. Due to technical limitations, some colours may vary.

Guarantee


All products offered are guaranteed for a period of twelve months unless otherwise stated from the date of the original invoice against failure to provide reasonable wear owing to defective workmanship or materials. The guarantee excludes faults caused by accident, neglect or misuse.

Please identify clearly the area or part that has failed. All items must be returned in a clean, dry condition, otherwise they may be returned to you without attention. Further advice is available by contacting our Customer Service Department during office hours.

Distance Selling Regulations


You have a right to cancel your order within seven working days following the day after the date of delivery for any unused item purchased through the catalogue or website under the distance selling regulations for refund. This does not apply to any perishable goods, unsealed software or item personalised or made to your specification.

To cancel any item, you can e-mail, fax or write to us quoting your customer number and order number. You must take reasonable care of the items, retain all original packaging and must not use them. Goods must be returned to us within seven days of your notice to cancel. Items may be returned to any Cotswold Outdoor store or to our Customer Service department. All goods are returned at your own expense unless the item is deemed faulty or incorrect, where we will refund the cost on receipt of the goods. Should you require your unwanted goods to be collected, we will deduct the appointed couriers direct costs from the refund given.

Providing the goods are received back in an unused condition and in their original packaging with all accessories, you will receive a refund within thirty days of your notice to cancel.

Force majeure


We will not be liable for non-performances of our obligations caused or resulting from industrial disputes or any other circumstances beyond the reasonable control of the company such as act of God, riots, civil commotion, flood, fire and legislation. If by reason of such circumstances it shall become impossible within a reasonable time for the company to wholly or partly supply the items ordered then the customer's liability will be limited to the value of the items already supplied together with any associated delivery charges.

Complaints


Any complaint or compliment can be sent to our Customer Service Department. We will endeavor to deal with you complaint within five working days of receipt. In the event where we cannot resolve your complaint immediately we will advise a likely time scale to you and keep you informed of any investigation.

Any information displayed on our web site(s) or other printed matter by the company is not regarded to be authoritative or certified as the best practice and is only considered to be useful supplementary advice to other certified codes of practice. All information on our web site is updated regularly.

Pricing and Print Errors


Prices and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions. We reserve the right to alter our prices and specifications without notice.

Ownership of Goods


All items supplied to the customer remain the property of the Cotswold Outdoor Ltd group until final payment of all sums owing in respect of those goods has been received in full by us.

LittleLife Facebook Competition rules:

1. This prize draw is open to residents of the UK and Republic of Ireland aged 18 years or over, except to employees of Cotswold Outdoor Limited, LittleLife and Monster Factory and their families, agents or anyone else professionally associated with the draw.

2. To be eligible for the competition you must send an image of your child's drawing to competitions@cotswoldoutdoor.com with your contact details.

3. The closing date for entries is 1st June 2012 (midnight). Late, or corrupt entries will not be accepted. No responsibility can be accepted for lost entries and proof of despatch will not be accepted as proof of receipt. We reserve the right to reject unsuitable drawings from this competition.

4. All drawings will then be uploaded into a facebook photo album on the Cotswold Outdoor facebook page where facebook users can cast votes by clicking 'like' on their favourite drawing. Voting closes on 8th June 2012 at midnight

5. The entry with the most votes will be the overall winner and the 4 entries with the next highest number of votes will win runner up prizes. The winners will be notified via the email address provided with entry within 24 hours of the closing date of the voting period.

6. The prizes as described are available on the date of publication and the winners may be required to participate in publicity.

7. Any personal data provided will be held and processed in accordance with the requirements of the Data Protection Act 1998.

8. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Any information provided via email as part of the competition is provided to Cotswold Outdoor Ltd and LittleLife and not to Facebook.

9. By entering this competition participants agree to be bound by these terms and conditions.

10. Events may occur that render the prize draw itself or the awarding of the prize impossible due to reasons beyond the control of the Promoter and accordingly the Promoter may at its absolute discretion vary or amend the promotion and the entrant agrees that no liability shall attach to the Promoter as a result thereof.
